These Terms & Conditions ("Terms") govern access to and use of BLOKKA's condominium management services, website and portal. They apply to committees, owners, residents, visitors and other authorised users. By using a BLOKKA service, you agree to these Terms.
Scope and Definitions
- BLOKKA: BLOKKA Condominium, the provider of the relevant condominium management service.
- Services: the condominium management, communication, portal and related services we provide.
- User: a committee member, owner, resident, contractor, visitor or other person authorised to use a Service.
Acceptance
By accessing or using the Services you agree to be bound by these Terms and any additional terms presented during use. If you do not agree, do not use the Services.
Our Services
The scope of services for a block is agreed with the relevant committee, owner or other client. Service notices, maintenance coordination, records, payment information and portal features may vary by block and by agreement. We may update or improve the Services from time to time.
Portal Accounts
- You must provide accurate and up-to-date information.
- Keep your login details confidential and do not share access with another person.
- Notify us immediately of any unauthorised use of your account.
- Use only the access provided to you and do not attempt to access another person's account or information.
Acceptable Use
You must not use the Services unlawfully, impersonate another person, infringe another person's rights, upload harmful material, interfere with the platform, or attempt to bypass access or security controls. We may restrict access or remove material where reasonably necessary to protect users, the Services or the rights of others.
Information and Documents
You remain responsible for the accuracy and lawfulness of information, documents and photographs you submit. You retain your rights in that material and give BLOKKA permission to store, access and use it only as reasonably necessary to provide, administer and secure the Services. Do not upload material that you are not authorised to share.
Payments and Billing
BLOKKA's management fees and block expenses are handled under the condominium's approved budget and management agreement. Contributions should be paid by the stated due date. If a payment is overdue, we may take recovery steps permitted by the agreement and applicable law, but we will not suspend a resident or owner's access to the portal or block information solely because of that overdue payment.
Third-Party Services
The Services may integrate with third-party providers (payment processors, hosting, etc.). Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control.
Intellectual Property
All BLOKKA branding, software and content are owned by BLOKKA. You may not reproduce or redistribute our content without permission.
Service Limitations
The Services are provided "as is" and "as available". We make reasonable efforts to ensure reliability, but we do not guarantee uninterrupted or error-free operation. Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, BLOKKA is not liable for indirect, incidental, special or consequential damages, loss of profits, or loss of data arising from your use of the Services.
Suspension and Termination
We may suspend or terminate your access if you breach these Terms or for operational reasons. You may close your account at any time; some data may remain where required for legal or legitimate business purposes.
Governing Law and Disputes
These Terms are governed by the laws of Malta. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Malta, unless otherwise required by mandatory law.
Changes to Terms
We may update these Terms. Material changes will be communicated and the revised date updated above. Continued use after changes constitutes acceptance.
